Agreement

Article 1 (Purpose)

These Terms and Conditions aim to stipulate the conditions and procedures for using the website services provided by Agricultural Corporation Co., Ltd. Pick-up Water Co., Ltd. (hereinafter referred to as the “Company”), as well as other necessary matters.

Article 2 (Effect and Change of Terms and Conditions)

  1. 1. These terms and conditions shall take effect upon notification to users.
  2. 2. The contents of these Terms and Conditions are posted on the service screen, and any changes to the Terms and Conditions are announced through the Company's online notice bulletin.
  3. 3. The Company may revise these Terms and Conditions if deemed necessary, and the changed Terms and Conditions shall take effect in the same manner as Paragraph 1.

Article 3 (Rules for Application of Terms and Conditions)

  1. 1. These Terms and Conditions shall apply together with the use regulations and separate terms and conditions regarding the services provided by the Company.
  2. 2. If matters not specified in these Terms and Conditions are stipulated in relevant laws and regulations, such provisions shall apply.

Article 4 (Definitions of Terms)

The definitions of terms used in these Terms and Conditions are as follows.

  1. 1. “Users” refer to individual members and corporate members who access the “Homepage” and avail services provided through the “Homepage” in accordance with these Terms and Conditions.
  2. 2. “Signing up” refers to the act of finalizing the service use agreement by filling out the relevant information in the application form provided by the Company and agreeing to these Terms and Conditions.
  3. 3. “Member” refers to a user who registers as a member by providing personal and/or corporate information to the Company on the “Homepage” and can receive information from the “Homepage” and use the relevant services continuously.
  4. 4. “ID” refers to a combination of letters and numbers entered by a member and approved by the Company for member identification and the use of services by the member.
  5. 5. “Password” refers to a combination of letters and numbers entered by a user to confirm that it matches his/her member ID and to protect the user’s confidentiality during communication.
  6. 6. “Withdrawal” refers to the act of a member terminating the use agreement.
  7. 7. Terms not defined in these Terms and Conditions are defined in separate terms and conditions and use regulations for individual services.

Article 5 (Membership Qualification and Application for Using Our Services)

  1. 1. Membership registration is completed after a user agrees to these Terms and Conditions and completes the prescribed registration procedures required by the Company.
  2. 2. The Company provides a member ID free of charge when a new user signs up for membership, and any person applying for the use of our services shall use his/her real name for the application.
  3. 3. Membership registration is established based on the Company's approval of the user's application for the use of our services and the user's consent to the Terms and Conditions.
  4. 4. After a user is registered as a member, the Company will show a screen to the qualified user that informs him/her of online member registration immediately upon application for membership.

Article 6 (Withdrawal of Membership and Loss of Membership)

If any of the following reasons apply, your membership may be restricted or suspended.

  1. 1. If it is found that you have used someone else’s name to apply for membership
  2. 2. If it is found that you have provided false information or attached false documents to your use contract application to apply for membership
  3. 3. If it is determined that your application is made for the purpose of hindering social well-being or public morals
  4. 4. If you commit any act of interfering with another person’s use of our services or stealing information related to our services
  5. 5. If it is found that you have used our site to engage in acts prohibited by the laws, regulations, and/or these Terms and Conditions.
  6. 6. If other use application requirements set by the Company are not met

Article 7 (Provision and Use of Our Services)

  1. 1. In principle, our services are available 24 hours a day, 365 days a year, unless there is a special problem with the Company's business or technology.
  2. 2. The Company may stop providing services in any of the following cases.
    1. A. When it is unavoidable for the maintenance of the system
    2. B. When the telecommunication service provider specified in the Telecommunications Business Act suspends telecommunication services
    3. C. In the event that any other reasons where the Company cannot provide the services arise
  3. 3. The services provided by the Company are as follows, and we may notify users of the changed contents of the services and provide the changed services for the services specified below.
    1. A. Homepage (Terms and Conditions for Membership)
    2. B. All other services developed by the Company or provided through cooperation agreements with other companies, etc.

Article 8 (Consent to the Use of Member Information)

  1. 1. Our privacy policy applies to members’ personal information.
  2. 2. Member information is collected, used, managed and protected by the Company as follows:
    1. A. Collection of personal information: The Company collects your information through the inputs provided when you signed up for our services, provided for your community activities, provided for your participation in various events, and provided by you to receive advertisements or to obtain prizes;
    2. B. Use of personal information: The Company does not disclose or distribute to a third party the personal information of a member collected in connection with the provision of our services without the member's consent. However, if there is a request from a state agency pursuant to the provisions of laws such as the Framework Act on Telecommunications, if there is a request for investigation of a crime, if there is a request by the Information and Communication Ethics Committee, if there is a request pursuant to procedures stipulated in other relevant laws and regulations, or if you voluntarily disclose the personal information you provided to us, this shall not apply;
    3. C. Management of personal information: To protect and manage personal information, you may edit/delete your personal information at any time in the member information section of the website;
    4. D. Protection of personal information: Only you can view/edit/delete your personal information, and it is managed entirely by your ID and password. Therefore, please do not reveal your ID and password to others, and be sure to log out and close the web browser window when you are done with you work (This is necessary to protect your information when you use a computer in a public place such as an Internet cafe or library where computers are shared with others); and
    5. E. Others: Please be aware that personal information you voluntarily provide online, such as on bulletin boards or through e-mail, may be collected and used by others. Personal information posted in public spaces may cause unwanted situations to you. You are responsible for maintaining the confidentiality of your personal information, and the Company does not bear any responsibility for any consequences resulting from the leakage of your personal information provided on such public spaces.
  3. 3. When a member applies for the use of our services in accordance with these Terms and Conditions, he or she is deemed to have agreed to the collection, use and provision of the member information stated in the application by the Company in accordance with these Terms and Conditions.

Article 9 (Information Security by User)

  1. 1. From the moment you complete the registration process for our services, you are responsible for maintaining the confidentiality of the information you entered, and you are responsible for all consequences arising from the use of your ID and password.
  2. 2. All responsibility for managing your ID and password lies with you, and if you discover that your ID or password has been used illegally, you shall immediately report the matter to us. All responsibility for failure to report lies with you.
  3. 3. You shall ensure that the connection is terminated accurately whenever you finish using our services, and if you do not terminate the connection correctly, the Company shall not bear any responsibility for damage or loss resulting from it, such as a third party using your personal information.

Article 10 (Provision of Information and Posting of Advertisements)

  1. 1. In the process of operating our services, the Company may provide various information to members by posting it on the website.
  2. 2. The Company may post advertisements on the website, send e-mails, etc. in relation to the operation of our services.

Article 11 (Copyright of Posts Submitted to the Company)

  1. 1. You have the rights to the content of your posts.
  2. 2. The Company has the right to edit or remove posted content without prior notice, and may delete it without prior notice in the following cases:
    1. A. If you make a post that violates these Terms and Conditions for Use or if your post is judged to be commercial, illegal, obscene, or vulgar;
    2. B. If the content of your post defames any other members or third parties by slander or mudslinging;
    3. C. If the content of your post violates public order and morals;
    4. D. If the content of your post is recognized as being linked to a criminal act;
    5. E. If the content of your post infringes on the copyright or other rights of a third party;
    6. F. Posts made by users that have withdrawn their membership; and
    7. G. If your post violates relevant laws and regulations.
  3. 3. You are solely responsible for any civil or criminal liability arising from your postings infringing upon the copyrights of others.

Article 12 (Obligations and Responsibilities of the Company)

  1. The services provided to you are owned and operated by the Company.
  2. The Company cannot divulge, disclose, or distribute to others a member's personal information obtained in connection with our services without obtaining the member's prior consent, and cannot use it for commercial purposes other than service-related purposes. However, exceptions are made in cases where it is necessary pursuant to relevant laws and regulations or for investigative purposes.

Article 13 (Obligations of Members)

  1. 1. Members shall comply with matters notified by the Company, such as relevant laws and regulations, the provisions of these Terms and Conditions, and use instructions and precautions, and shall not engage in any actions that interfere with the Company's business.
  2. 2. Members shall not engage in any commercial activities using our services without obtaining the Company’s prior consent.
  3. 3. Members shall not use the information obtained through our services by copying, duplicating, modifying, translating, publishing, broadcasting, or otherwise providing the information to others without the prior consent of the Company.
  4. 4. Members shall not engage in any of the following acts in relation to the use of our services:
    1. A. Fraudulent use of another member’s ID;
    2. B. Activities for criminal purposes or related to other criminal activities;
    3. D. Harming good morals or social order;
    4. D. Any act of defaming or insulting others’ reputation;
    5. E. Any act of infringing upon others’ rights, such as intellectual property rights;
    6. F. Hacking or spreading computer viruses;
    7. G. Any act of transmitting certain contents, such as advertising information, against the will of others;
    8. H. Changing the information posted on the website of the Company;
    9. I. Any act that interferes or may interfere with the stable operation of our services; and
    10. J. Any act that violates relevant laws and regulations.

Article 14 (Changes in Member Information)

  1. If there is a change in member information (address, e-mail address, etc.), the relevant member shall notify it immediately and make corrections on the website operated by the Company.
  2. The relevant member is solely responsible for failure to notify or modify the change in member information, which may be grounds for suspension or termination of our services provided to the member.

Article 15 (Deletion of Post or Content of Post)

The Company may delete a post or move the content of a post without prior notice to or consent of the relevant member if it violates the regulations or exceeds the Company's prescribed posting period.

Article 16 (Contract Termination and Restrictions on the Use of Our Services)

  1. 1. In the event that a member wishes to cancel the service agreement, he or she shall apply for it to the Company through the service page on the Company website or e-mail at least 1 day prior to the date on which the member wishes to cancel the service agreement (however, if the termination date is a legal holiday, the application shall be submitted no later than 2 days prior to the start of the holiday).
  2. 2. The Company may terminate the service use agreement if a member violates these Terms and Conditions and does not terminate the agreement within the Company's designated period.
  3. 3. The Company may restrict or suspend the use of our services by any member who violates the terms of the contract without obtaining his/her prior consent.
  4. 4. The Company has the right to suspend and terminate our services provided to a member if the member's use is inconsistent with the member's contract or the member engages in an act that violates the laws and regulations.

Article 17 (Compensation for Damages)

The Company shall not be liable for any damage incurred by members in connection with our services provided free of charge, unless such damage is caused by the Company's gross negligence.

Article 18 (Disclaimer)

  1. 1. If the Company is unable to provide services due to natural disasters or other force majeure, the Company shall be exempt from liability for suspension of service provision.
  2. 2. The Company shall be exempt from liability for any disruption in the use of our services due to reasons attributable to users.
  3. 3. The Company shall be exempt from liability for any damage suffered by a user due to information obtained by the user using our services.
  4. 4. The Company shall be exempt from liability for the reliability or accuracy of information provided through the service network provided by the Company.
  5. 5. The Company shall be exempt from liability for the content of materials posted or transmitted by users.

Supplementary Provision 1.

(Enforcement Date) These terms and conditions shall come into effect on December 08, 2024.

(hereinafter referred to as the “Company”) notifies and provides guidance on the following matters regarding the collection and use of the personal information pertaining to companies/organizations and individuals in accordance with relevant laws and regulations.

Personal Information Items Collected

When you register as a member or use various services provided by the Company, the Company collects and uses the minimum amount of personal information to provide convenient and useful customized information to you for smooth receipt of your orders, services, product delivery, and payment.
- Items collected: Name, date of birth, gender, login ID, password, home phone number, home address, mobile phone number, email address, cookies, payment records, access logs, and information on access IP
- Method of collecting personal information: Website (Information entered for membership subscription)

Purpose of the Collection and Use of Personal Information

The Company uses the collected personal information for the following purposes.

Fulfillment of contract for the provision of services and settlement of fees for the provision of services, provision of contents, purchase, payment of purchase price, delivery of products, billing, identity verification for financial transactions, and financial services.

- Member management: Verification of identity for the use of membership services, personal identification, prevention of unauthorized use and fraudulent use by delinquent members, confirmation of intent to sign up for membership, management of member complaints such as complaint handling, and delivery of notices

- Used for marketing and advertising: Delivering advertising information such as event notifications, identifying the frequency of access, or statistics on members’ service use Information provided by members will not be used for purposes other than those described above, and if the scope, purpose, or use of the collected information changes, necessary measures will be taken, such as obtaining separate consent.

Retention and Use Period of Personal Information

In principle, after the purposes of collecting and using personal information have been achieved, personal information is destroyed without any delay. However, if retention is necessary in accordance with the provisions of relevant laws and regulations, the Company will retain member information for a certain period of time specified in the relevant laws and regulations as follows.

Basis of Items Required to be Retained and Payment Records

  • - Retention period for records related to contracts or withdrawal of subscription: 3 years
  • - Records on contracts or withdrawal of subscription, etc.: 5 years (Act on Consumer Protection in Electronic Commerce, etc.)
  • - Records of payment and supply of goods, etc.: 5 years (Act on Consumer Protection in Electronic Commerce, etc.)
  • - Records of consumer complaints or dispute settlement: 3 years (Act on Consumer Protection in Electronic Commerce, etc.)

Procedures and Methods for the Destruction of Personal Information

In principle, the Company destroys personal information without any delay after the purposes of the collection and use of personal information have been achieved. Destruction procedures and methods are as follows.

Destruction Procedures
The information you entered for membership subscription, etc. is transferred to a separate DB (in the case of paper, a separate filing cabinet) after the purposes are achieved. It is stored for a certain period (refer to the retention and use period) according to the reasons for information protection according to internal policies and relevant laws and regulations, and is destroyed after the expiry of the said period.
Personal information transferred to a separate DB will not be used for any purposes other than those for which it is retained, unless required by laws or regulations.

Method of Destruction
Personal information stored in electronic file format is destroyed using technical methods that render the records unrecoverable.
